Standard Form Essentials: Indigenous Lands, Contracts, and Disclosures

In Standard Form Essentials: Indigenous Lands, Contracts, and Disclosures, REALTORS® are introduced to a brief history of Indigenous peoples in Canada, learn about historic and modern treaties, and familiarize themselves with the four governance regimes applicable to Indigenous lands in British Columbia. Building on this knowledge, learners dive into the Property Disclosure Statement for First Nations form, and the associated Homeowners Association (HOA) schedule, as well as the two Contract of Purchase and Sale for First Nations forms developed by BCREA.
After completing this course, learners will be able to explain the differences between Indian reserve land, treaty land, land under a self-government agreement, and First Nation land under a land code. They will also be able to explain why all Indigenous lands are treated as leasehold property, identify the landlord in each case, determine what legislation potentially applies, and find the parcel abstract at the appropriate land registry.
The primary goal of this course is to equip new and experienced REALTORS® with the knowledge and skills to navigate transactions involving Indigenous lands, whether they represent sellers, buyers, or developers.
